SONDAG COLLECTIVE TERMS & CONDITIONS
By using this website, or by ordering any of our products, you, the user of this website, or in the event of an order for products, the customer, (hereinafter both referred to as “the customer”) agree to be bound by these Terms & Conditions and our Privacy Policy. Please read these Terms & Conditions and our Privacy Policy carefully before using our website or ordering any products from us.
By placing an order at Sondag Collective, you warrant that you are at least 18 years old or have parents' consent & permission to transact with us.
- PERSONAL INFORMATION
- Please review our detailed Privacy Policy which outlines all aspects of Personal Information collection, use, editing, sharing and protection prior to utilizing our website or ordering any of our products.
- RETURNS & REFUNDS
- If, for any reason, you are not happy with your purchase and wish to return or refund, we only accept returns at our sole and unfettered discretion, for products which are unworn and have all hygiene stickers still in place and unwashed.
- Return shipping for any returned product shall be at the customer’s expense.
- Any sale items ordered or purchased are for final sale and are not eligible for return.
- We do not accept exchanges that are worn, soiled or stained.
- We do not offer or agree to payment of refunds under any circumstances. Any return accepted by us will be reimbursed by way of an in-store credit.
- For sanitary reasons please try on swimwear over your underwear.
- For any returns, kindly note the following conditions and requirements:
- You have 14 days from the date of delivery of your order to send any product back to us that you wish to return for a store credit.
- Returned products must be unworn, have hygiene stickers in place, all swing tags must be attached, and must be in perfect re-sale condition.

- Unworn items must be returned in original SONDAG bag.
- Your in-store credit will be issued once items have been received and inspected by the returns team.
- If the return is approved, our store credit notification will be received via email within 3-5 working days from date of our receipt of the returned product.
- Items that are non-exchangeable and non-returnable include:
- Items marked as final sale.
- Sale items including items purchased during flash sales or with a code above 15%.
- Items that have been worn or with the hygiene sticker and/or tags removed.
- Items that have been marked, stained, soiled, or damaged or not in perfect re-sale condition.

- DELIVERY
- Any delivery time stipulated by Sondag Collective is offered as a non-binding estimate and guideline only and are not guaranteed by Sondag Collective.
- Sondag Collective endeavours to meet estimated delivery times, however actual delivery dates may vary due to factors beyond our control.
- Sondag Collective shall not be held liable for any direct or indirect losses, costs, damages, charges, or expenses caused by any delay in the delivery of products.
- Customers are responsible for providing accurate delivery information at the time of order. Failure to provide correct addresses, contact or other related information may result in delivery delays or the return of products to Sondag Collective. In such cases, the customer may be liable for additional shipping and handling fees for the redelivery of the order.
- For orders requiring international shipping, customers are advised that customs clearance is beyond the control of Sondag Collective and may affect delivery times.
- PAYMENT
- All products remain Sondag Collective's property until full payment is made. If you are under 18 years of age, you must have parents’ permission to transact with Sondag Collective.
- All transfers conducted through Sondag Collective are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled via SSL encryption.
- Please ensure you familiarize yourself with the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.
- LOCAL TAXES
- Customers should be aware that orders may be subject to additional charges, including but not limited to sales tax, customs duty, and any other government-imposed fees and taxes, based on the destination region and applicable local customs regulations. The responsibility and liability for these additional charges rests solely with the customer.
- It is the customer's duty to inform themselves about their local customs policies, tax obligations, and any other fees or penalties that may be levied on their purchase, as these vary by region and change over time. Sondag Collective does not have control over these charges and cannot predict their amount. The refusal to accept or pay for any additional charges, fees, or penalties may result in the delivery being delayed, returned, or disposed of, with no entitlement to a refund from Sondag Collective. The customer indemnifies Sondag Collective for any loss, damage or claim it may wish to recover or pursue as a result of any additional charges, fees, or penalties arising or any of these potential circumstances occurring.
- Any additional charges required for customs clearance or other purposes may be collected by the shipping company on behalf of the local customs authority and are not included in the purchase price or shipping costs provided by Sondag Collective at the time of order.
- FORCE MAJEURE
- In the event of circumstances or events occurring beyond Sondag Collective's reasonable control, which could not have been reasonably anticipated, which affect Sondag Collective’s ability to honour orders or sales, or comply with any of the terms and conditions herein or applicable to any order or sale, such circumstances or events shall be recognized as force majeure.
- Force majeure encompasses, but is not limited to, the following occurrences: conflicts, embargoes, fires, floods, acts of sabotage, unforeseen accidents, warfare, acts of terrorism, natural calamities (including but not limited to earthquakes, hurricanes, tsunamis, and volcanic eruptions), labour strikes, and disruptions in supply from vendors or manufacturers, actions or inactions by government authorities, enactment or modification of laws, decisions made by governmental bodies that adversely impact the market and our products, such as restrictions, advisories, prohibitions, and any form of regulatory control that was not anticipated.
- Upon occurrence of a force majeure event, Sondag Collective shall endeavour to notify affected customers promptly, detailing the nature of the event and its potential impact on Sondag Collective's ability to perform its obligations. Sondag Collective reserves the right to suspend, delay, modify, or cancel performance obligations, orders or sales, without any liability, until such time as the force majeure event ceases to exist or no longer impedes Sondag Collective's performance capabilities.
- Should the force majeure event extend beyond a continuous period of 60 days, either party may opt to terminate the affected contractual agreement or order upon written notice to the other party, without incurring liability for such termination.
- Customers are encouraged to maintain open communication with Sondag Collective during the force majeure event to facilitate any necessary adjustments to orders affected thereby.
- INTELLECTUAL PROPERTY RIGHTS
- All intellectual property (IP) associated with Sondag Collective and its website, including but not limited to images, drawings, designs, text, logos, trademarks, and any other materials displayed or made available through our online platforms is the exclusive property of Sondag Collective and is protected under international intellectual property laws, including copyright, trademark, patent, and trade secret laws, as well as other applicable proprietary rights and laws.
- All content featured or displayed on the Sondag Collective website, including, without limitation, graphics, visual interfaces, interactive features, textual content, logos, and the compilation of all content on the site, is owned by Sondag Collective unless otherwise patent from context. These elements are protected by copyright and other laws and cannot be copied, imitated, reproduced, republished, posted, transmitted, sold, or otherwise exploited for any commercial purpose without the express written consent of Sondag Collective.
- The use of any Sondag Collective intellectual property, including any content made available on the website, without obtaining prior written permission from Sondag Collective, is strictly prohibited. This prohibition includes, but is not limited to, modifying, distributing, transmitting, performing, broadcasting, publishing, uploading, licensing, reverse engineering, or creating derivative works from any material, information, or technology contained on our website. Unauthorized use of Sondag Collective’s intellectual property may violate intellectual property laws and could result in significant civil liability and/or criminal consequences.
- The trademarks, service marks, logos, and any other company or product names appearing on the Sondag Collective website are, unless otherwise noted or patent from context, the trademarks of Sondag Collective (the “Marks”). All other trademarks, service marks, and logos used on the website are the trademarks, service marks, or logos of their respective owners. The Marks owned by Sondag Collective, whether registered or unregistered, may not be used in connection with any product or service that is not offered by Sondag Collective, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Sondag Collective.
- WARRANTIES AND DISCLAIMERS
- Sondag Collective sells all products on an "as is" and "as available" basis without any representations, warranties, or conditions of any kind, either express or implied, including but not limited to implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. These warranties insofar as they may be implied are herewith explicitly excluded from application to the extent permissible in law.
- While Sondag Collective strives to ensure that the information on its website, including product descriptions, pricing, and availability, is accurate and up to date, errors may occur. Sondag Collective does not warrant that the product descriptions, prices, or other content provided on the website are in all instances error-free. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of Sondag Collective. We reserve the right to discontinue any product at any time.
- The inclusion of any products on the Sondag Collective website does not imply or warrant that these products will be available at any given time. Product availability is subject to change without notice. Sondag Collective reserves the right, without liability or earlier notice, to change, discontinue, or cease to make available any product or to cancel any order.
- LIMITATION OF LIABILITY
- Sondag Collective, including its officers, employees, affiliates, or agents shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort or delict (including negligence), strict liability or otherwise, arising from the customer’s use of any part of the Sondag Collective website or any products, or in respect of any other claim related in any way to your use of the website or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the website or any content (or product) posted, transmitted, or otherwise made available via the website.
- In the event that any applicable jurisdiction does not allow the exclusion or the limitation of liability for consequential or incidental damages, Sondag Collective’s liability in this regard shall be limited to the maximum extent permitted by law.
- THIRD-PARTY PLATFORMS
- Sondag Collective operates its online retail services through Shopify, a third-party platform. Shopify is not accountable for the management, control, or oversight of the content presented, the interactions between users, or the transactional processes conducted on the Sondag Collective website.
- Responsibility for content accuracy, user engagement, and the security of transactional data on the Sondag Collective website lies solely with Sondag Collective and not with Shopify or any other third-party platforms that may be utilized.
- Customers and users acknowledge that the operational functionality and technical support relating to Shopify, or any other third-party platform operate independently of Sondag Collective. Sondag Collective disclaims and is indemnified by the customer in respect of any liability of any nature and howsoever arising insofar as it pertains to Shopify or any third-party platforms, including matters pertaining to inter alia technical failures, operational interruptions, or other service-related issues arising directly from such third-party platforms.
- Shopify is not responsible for any content on the Sondag Collective website.
- ADDITIONAL GENERAL PROVISIONS
- Sondag Collective reserves the right to amend these terms and conditions and the information exhibited on its website or upon any other platform, including but not limited to prices, technical specifications, terms of purchase and product offerings, without prior notice. If any product becomes sold out, Sondag Collective has the right to cancel any order for such product and refund any amount via an in-store credit. Sondag Collective may notify the customer of equivalent replacement products if available.
- All legal matters relating to the Sondag Collective’s products or website, these Terms and Conditions, or any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Republic of South Africa.
- Any legal proceedings arising out of, or related to, these Terms and Conditions, Sondag Collective’s products or website shall be dealt with exclusively by the Courts and jurisdiction of the Republic of South Africa, subject to Sondag Collective retaining the right to bring any suit, action, or proceeding against a customer for breach of these Terms and Conditions or otherwise in the customer’s country of residence or any other relevant or appropriate country. You irrevocably and unconditionally consent to the jurisdiction of the South Gauteng High Court situated in Johannesburg, South Africa, in respect of any dispute which may arise between us. In addition to the aforesaid, you irrevocably and unconditionally consent to the jurisdiction of the relevant Magistrates Court having jurisdiction, even though the value of a claim which we may have against you may exceed the monetary jurisdiction of such Court.
- If any provision in these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, such term should be interpreted restrictively to such degree necessary to render same lawful and enforceable. If any unlawful and/or unenforceable provision (or part thereof) cannot be interpreted in such a way to render it lawful and enforceable, such provision (or part thereof) should be deemed to be deleted, and the rest of the provision and other unaffected provisions should continue to operate in full effect.
- Sondag Collective reserves the right, in its sole discretion, to revise or update these Terms and Conditions at any time and without prior notice. It is your responsibility to review these Terms and Conditions periodically for changes. Your continued use of the website following the posting of revised Terms and Conditions means that you accept and agree to the changes.
- Sondag Collective may transfer, cede, assign, or delegate its rights and obligations under these Terms and Conditions and any other rights and obligations insofar as they relate to the customer without requiring the customer’s prior consent. The customer however is prohibited from the transfer, assignment, cession, or delegation of his or her rights or obligations under these Terms and Conditions without the prior written consent of Sondag Collective.
